Article 2 - Object

These general terms and conditions of sale (hereinafter "GTCS") are intended to define the contractual conditions of sale between the company YASAH ECOM LLC (hereinafter "the Seller") and the Buyer, within the framework of the sale of products offered on the site www.damivas.com.

Article 3 - Acceptance of the GTCS

The GTCS are accessible at all times on the site www.damivas.com. By placing an order, the Buyer acknowledges having read and accepted these GTCS without reservation.

The GTCS may be modified at any time, and modifications will apply to any order placed after their update.

Article 4 - Products

The products offered for sale are those appearing on the site www.damivas.com on the day the Buyer consults the site.

The characteristics of the products are presented on the site, within the limit of the information available.

The Seller strives to ensure the availability of products for sale, but cannot guarantee the permanent availability of all products.

Article 5 - Order

The Buyer places their order directly on the site www.damivas.com. Once the order is validated, the Buyer will receive a confirmation email.

The Seller reserves the right to refuse any order suspected of fraud or that does not comply with the GTCS.

Article 6 - Price

Product prices are indicated in euros, inclusive of all taxes (VAT included).

Shipping costs are free.

The Seller reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of order validation.

Article 7 - Payment

Payment is made by credit card, bank transfer, or any other means offered on the site.

The Buyer guarantees that they have the necessary authorizations to use the chosen payment method.

Payments are protected by an encryption protocol.

Article 8 - Delivery

Products are delivered to the address indicated by the Buyer during the order process.

Deadlines are given for indicative purposes. In case of delay, the Buyer can contact customer service at support@damivas.com.

The Seller cannot be held responsible for delays related to the carrier or a case of force majeure.

Article 9 - Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Buyer has 30 days to exercise their right of withdrawal.

They must notify their decision by email to support@damivas.com.

Products must be returned in their original condition and packaging. Return costs are the responsibility of the Buyer.

Article 10 - Warranties

Products are guaranteed against manufacturing defects in accordance with current legislation.

In case of a defective product, the Buyer has 30 days to request a replacement or a refund.

The warranty does not cover normal wear and tear or damage due to misuse.

Article 11 - Liability

The Seller cannot be held liable for any indirect damage related to the use of the site or the products.

Their liability is limited to the amount of the order.

Article 12 - Intellectual Property

All elements of the site www.damivas.com are protected by copyright and trademark law.

They may not be copied or exploited without prior written authorization.

Article 13 - Personal Data

Data is processed in compliance with Law No. 78-17 of January 6, 1978.

The Buyer can exercise their rights of access, rectification, and deletion by contacting support@damivas.com.

Article 14 - Disputes

In the event of a dispute, the parties undertake to seek an amicable solution.

Failing that, the courts of the jurisdiction of the Seller's registered office shall be competent.

Article 15 - Applicable Law

These GTCS are subject to French law.

In the event of a dispute, French jurisdictions shall have exclusive competence.
